INTER-INSTITUTIONAL AGREEMENT

AGREEMENT BETWEEN THE NATIONAL COUNCIL FOR CHILDREN AND THE LABOR MINISTRY FOR THE CREATION OF AN INFORMATION CENTER ON CHILDREN AND FAMILY

 BETWEEN: 

THE NATIONAL COUNCIL FOR CHILDREN, Governmental Institution under the Administrative Secretariat of the Presidency of the Republic, created by Decree number 426 passed on the 23rd of November of the year 1978, duly represented by its President LOURDES ISABEL MEJÍA DE GRULLÓN, Dominican, of legal age, married, bearer of the identity and electoral card number 001-0201514-6, who will hereinbelow, for the purposes and consequences of this agreement, be called CONANI, THE INTER-AMERICAN CHILDREN’S INSTITUTE, a specialized organization forming part of the Organization of American States (OAS), duly represented by the Official Representative of the Dominican Republic and President of the IIN’s Directing Council, CARMEN BERGES DE AMARO, Dominican, of legal age, married, bearer of the identity and electoral card number 001-0122325-3, who will for the purposes and consequences of this agreement be called IIN, and the other party which is the LABOR MINISTRY, an official institution which directs the national policy, created and established through Law number 1312, passed on the 30th of June of 1930, with its Head Office located in this city, on  Jiménez Moya Avenue, number 5, Centro de los Héroes de Constanza, Maimón y Estero Hondo, duly represented by the Labor Secretary, MILTON RAY GUEVARA, Dominican, of legal age, married, attorney for the courts of law of the Republic, domiciled and residing in this city, bearer of the identity and electoral card number 031-0109157-1, who will hereinbelow be called SET. 

CONSIDERING: 

That the National Council for Children (CONANI) is a normative assisting institution, which has specific duties concerning children and adolescents, family and community, providing direct assistance through its internal and external work being carried out through its Operational Units. As an Institution specialized in carrying out actions aimed at assisting children and adolescents it is a member of the Organization For Directing the System for the Protection of Children and Adolescents. 

That along these lines the SET signed on the first day (1st) of November of the year two-thousand and one (2001) a `GENERAL AGREEMENT OF COOPERATION’ with the Inter-American Children’s Institute, which includes, among other objectives, the following:

`Promoting SET’s participation, and particularly the participation of the National Directing Committee for the Struggle Against Child Labor in the Inter-American NETWORK of Information on Childhood’

That in order to fulfil the aforementioned objective and considering that CONANI has been designated by the Inter-American Children’s Institute as a Coordinating Center (at national level) of the NETWORK of Centers of Information on Children and Family, SET is signing this agreement for technical cooperation.

That the Inter-American Children’s Institute (IIN) has been promoting since 1988 the Inter-American Network of Information on Childhood (RIIN), for which there are three databases operating ( Document, Organizational and Project Database);

That cooperation between similar organizations -and particularly between organizations within the Inter-American System-, is important in order to attain a more considerable and more efficient utilization of their resources to benefit countries in the hemisphere, all of which will contribute to the development of a national capacity for responding to the needs of children, adolescents and their families;

That both CONANI and the IIN have signed an agreement on the 23rd August 2001 for setting up a National Center for Information on Children and Family.

That CONANI is the Coordinating Center (working at national level) for the NETWORK of Centers of Information on Childhood and Family, which CONANI is allowed to set up according to the agreement signed with the IIN.

THEREFORE:

The NATIONAL CENTER FOR CHILDREN (CONANI) and the SET agree to create an INFORMATION CENTER ON CHILDREN AND FAMILY, which will act as the Center using the National Network of Information on Children and Family for the Dominican Republic, which forms part of the RIIN.

FIRST CLAUSE
OBJECTIVES
 

This Information Center will have the following objectives: 

Article 1. Receiving, selecting and systemizing all information and documentation being produced in the Dominican Republic on the subjects of children, adolescents and family concerning legal, social, and educational aspects, as well as other such as health and drug addiction prevention, having the Convention on Children’s Rights as a reference. 

Article 2. Receiving, selecting and systemizing all reference information on institutions, projects and events taking place in connection with the subjects stated in Article 1.

Article 3. Diffusing within the Dominican Republic all the information on children, adolescents and family generated in this country, as well as the information received by the IIN from the rest of America and the documentation that does not belong to the Inter-American System but that directly or indirectly contributes to improving the quality of life of Dominican children, adolescents and families.

 Article 4. Periodically sending to the National Center of Information on Children and Family the information and documentation received, in order to enter this information in the common databases and make it available for all users of the System in the region. 

Article 5. Providing users in the Dominican Republic and users of the RIIN Network in the rest of the region with copies of the original documentation in accordance with the mechanisms agreed by common consent. 

SECOND CLAUSE
TERMS OF THE AGREEMENT
 

Article 1. CONANI will hand over the OPD System -specially programmed by the IIN-and the documentation concerning this system, to the SET, as a `licensed user. 

Article 2. CONANI will provide the necessary training and technical support in order for the Usufructuary Center to function properly. 

Article 3. The SET will provide adequate facilities needed for the Usufructuary Center to function, as well as the necessary furniture and equipment (computer, photocopier), which make it possible to attain the objectives pursued by this agreement. 

Article 4. The SET will be in charge of providing the necessary staff in order for the Usufructuary Center to function properly. 

Article 5. The SET will be in charge of all setting-up, training and maintenance expenses concerning the Usufructuary Center, and will provide the necessary conditions for the center to operate. 

Article 6. The SET will inform CONANI about the activities connected with the Usufructuary Center. 

Article 7. The SET will not be allowed to hand over any computer software connected with these programs to a third party, or to partially or totally commercialize information belonging to the OPD System. 

Article 8. The SET will be allowed to incorporate announcements in the Information Magazines and in other documents being produced, all of which will have to be approved by both parties before being published. These announcements will have to be consistent with the characteristics and purposes of the Organization of American States, the IIN and CONANI. 

Article 9. The SET will use the Internet in order to have access to electronic mail, electronic conferences and databases which enable a dynamic information exchange with the other Centers of the Inter-American Network of Information on Childhood and Family, as well as to make usufructuary institutions have access to online consulting services. 

Article 10. The SET will ensure the continuity of human and material resources allocated for this project, in order for them to be used in attaining the aims derived from this agreement. 

THIRD CLAUSE
FINAL PROVISIONS
 

This Agreement will come into force after having been signed by the parties involved, and will retain its validity for a period of 24 months, being renewable prior to the evaluation of CONANI and the SET. The first renewal will be expressly carried out, and the subsequent ones will take place automatically, each renewal having a duration of 24 months. 

This Agreement may be rescinded at the request of one of the parties, 90 days beforehand. In this case, SET will not be allowed to continue using the programs and databases according to this Agreement, and they will have to be returned to CONANI.

The terms of this Agreement may be altered by the parties’ express common consent. 

This Agreement has been signed between MRS. LOURDES ISABEL MEJÍA DE GRULLÓN, Secretary of State, President of the National Council for Childhood,

CARMEN BERGES DE AMARO, Delegate to the IIN’s Directing Council, and MILTON RAY GUEVARA, Secretary of State for Labor, in the city of Santo Domingo this 4th day of February of the year 2003.
